Disciplinary Panel result of a fast-tracked case

1.  

 On 25th November 2023, Charlie Case rode his fifth winner at Ascot. It is accepted by him that he had in fact ridden two winners in New Zealand, on 26 June 2022 and 2 July 2022 but failed to notify The Racing Callender Office (Weatherby) of this as required under the Administrative Rules of Racing, therefore his tally of winners was incorrect.

On 27th February 2024 when riding ULTRA VIERS (IRE) at Leicester, an incorrect weight allowance was applied as the claim had not been amended to reflect the correct claim for a jockey with more than five career wins. Paragraph 54.1 of Rule (I) Weight Allowances states that an amateur jockey who has ridden their fifth winner has their claim reduced from 7lbs to 5lbs in Amateur races. By failing to claim the correct weight allowance at Leicester, he accepts being in breach of paragraph 51 of the Weights and Handicapping Code, which requires Jockeys to claim the correct weight allowance in any race.

 Upon the British Horseracing Authority (“BHA”) becoming aware of the incorrect claim, on 8th April 2024 they lodged a notice of objection to the race in accordance with Rule (L)47.7 (Horse Disqualifications) on the grounds that the incorrect claim by Charlie Case meant that it had carried less weight than it should have carried.

Both the owner/trainer of ULTRA VIERS (IRE) and Charlie Case were notified of the BHA’s objection notice. Charlie case was charged with the breach on 10th April 2024 with the BHA indicating the matter was deemed suitable for disposal under the fast-track procedure.

The BHA propose a sanction for the admitted breach of a financial penalty of £350 or in the alternative a two-day suspension. This was accepted by Charlie Case on 12th April 2024 indicating preference for a financial penalty.

The Table of Penalties indicate an entry point of £250 with a range to £1000. The rationale for imposing a higher penalty than the entry point is based upon aggravating facts of two relicensing applications in October 2022 and 2023, where declarations had been signed failing to fully declare the correct number of winners during his career.  Having considered all the relevant circumstances, I agree with the proposed penalty.

 I confirm that the penalty imposed in respect of this matter is a financial penalty of £350 in respect of the breach of Rule (I)51 and disqualification of ULTRA VIERS (IRE) in consequence of Rule (L)47 in respect of the placing at Leicester on 27th February 2024.
